KIZMIT Terms of Service

These Terms of Service ("Terms") govern your access to and use of the KIZMIT application and website at kizmit.app (the "Service"), operated by ‹‹FILL IN: LEGAL ENTITY NAME›› ("KIZMIT," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What KIZMIT is
KIZMIT is a personal wellness and reflection tool. It displays your calendar alongside ambient conditions, such as the lunar phase and barometric pressure, and lets you record how events and days feel to you so that personal patterns can emerge from your own data. KIZMIT is for personal, informational, and reflective use only.
KIZMIT is not a medical device and does not provide medical, psychological, or health advice. Nothing in the Service is a diagnosis, treatment, or substitute for professional care. KIZMIT does not predict outcomes or tell you what to do; it reflects your own data back to you. Always consult a qualified professional for health decisions.
2. Eligibility and your account
You must be at least 16 years old to use KIZMIT. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly if you believe your account has been accessed without authorization.
3. Connecting your Google Calendar
KIZMIT's calendar features are optional and work only if you connect a Google account. If you connect, you grant KIZMIT read-only access to your Google Calendar (the calendar.readonly scope) so the Service can display and reflect your events. KIZMIT cannot create, change, or delete anything on your calendar. You can disconnect at any time within KIZMIT or from your Google Account permissions page. Your use of Google services through KIZMIT is also subject to Google's own terms. How we handle calendar data is described in our Privacy Policy.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to access accounts, data, or systems that are not yours, or to probe, scan, or breach security measures.
- Copy, modify, reverse-engineer, scrape, or create derivative works from the Service except as permitted by law.
- Interfere with or disrupt the Service, or use it to build a competing product using our proprietary materials.
- Misrepresent your identity or use the Service to harm others.
5. Your content and data
You own the information you put into KIZMIT, including your check-ins and any optional entries. You grant us a limited license to store and process that information solely to operate and provide the Service to you, as described in our Privacy Policy. We do not claim ownership of your personal data and we do not sell it.
6. Communications
When you create an account, you agree to receive service and transactional messages necessary to operate your account, such as security notices and important changes to the Service. Separately, you may opt in to receive marketing and educational communications; these are never required, and you can withdraw at any time. How we handle communications and your preferences is described in our Privacy Policy.
7. Our intellectual property
The Service, including its name, design, software, text, and the KIZMIT brand, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended personal purpose. These Terms do not transfer any ownership rights to you.
8. Third-party services
KIZMIT relies on third-party providers (including Google for calendar data, Open-Meteo for weather, and our backend and email providers) to function. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them may be governed by their own terms.
9. Availability, changes, and beta status
KIZMIT is offered on an evolving basis and may include pre-release or beta features. We may add, change, suspend, or discontinue any part of the Service at any time, and we do not guarantee uninterrupted or error-free operation. We will make reasonable efforts to communicate significant changes.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be accurate, reliable, or available at any particular time. Any reliance you place on the Service is at your own risk.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KIZMIT AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. Our total liability for any claim relating to the Service will not exceed the greater of amounts you paid us in the prior 12 months or USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold KIZMIT and its operators harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of applicable law.
13. Termination
You may stop using the Service and delete your account at any time using KIZMIT's built-in account-deletion feature. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
14. Governing law and disputes
The Service is intended for users in the United States. These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the courts located in ‹‹FILL IN: COUNTY/JURISDICTION for disputes, e.g. Montgomery County, Maryland››, unless applicable law requires otherwise.
15. Changes to these Terms
We may update these Terms as KIZMIT evolves. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
